Please read these terms and conditions carefully, as your use of this Website constitutes your acceptance of these terms and conditions. Any changes to these terms and conditions become effective as of the time of posting.

Customer Information:  Please review our Security and Privacy Statement, which also governs your visit to the Website.

Warranty: iSimple products carry a one (1) year warranty against defects in workmanship or materials, not including normal wear and tear or abuse of the product. To redeem your warranty you must provide iSimple with an invoice or receipt as a proof of purchase. iSimple will only replace or repair warranted items, no refunds will be given. iSimple reserved the right to inspect or test all products prior to a warranty claim. This process typically takes between four (4) and eight (8) weeks. You must contact either iSimple Customer Service or Technical Support prior to any return attempt. All iSimple products are warranted to be free from defects prior to installation. Any modification or improper use of an iSimple product will void this warranty. The iSimple warranty does not cover installation or damages caused by installation. Proper installation and use of iSimple products will not void any automaker warranty.  The iSimple warranty also does not cover any third party products, even if sold through the Website.

3rd Party Products: Throughout the Website, iSimple sells select third party merchandise.  Such items may be shipped from a different warehousing location, and may arrive in a separate package. Availability of such items may be limited and they may be backordered from time to time. Please contact Customer Service if you fail to receive your third party items in a timely manner. For any shipping damages or disputes, please follow the guidelines above.

Liability: neither iSimple, AAMP of Florida, Inc., any of their subsidiaries or affiliates, Nor any such person's or entity's respective partners, officers, directors, employees, shareholders, representatives or agents may be held liable for direct, special, incidental, consequential, punitive, or indirect damages arising from, but not limited to, the sale, transportation, installation, use or repair of its products, or the use of this website, which is available on an "as is" and "as available" basis. You, as an iSimple customer, will be responsible for selecting a reputable installer with current liability insurance to cover any damage that may arise through installation of an iSimple product. Should the customer choose to install the product hm/herself, iSimple is not liable for any damages to property or injuries incurred by the consumer or other parties. iSimple's listing and recommendation of an installer or installation facility does not constitute grounds for any liability. You therefore agree that iSimple's maximum liability arising from any product sold by iSimple shall not exceed the price of such product. Some jurisdictions do not allow the limitation of exclusion of liability for certain damages, so the above may not apply to you to the extent such jurisdiction's law is applicable to this agreement.

Pricing: All prices are in United States Dollars ($US). Prices, specifications and availability of products are subject to change without notice. Pricing and availability errors will be corrected where discovered, and iSimple reserves the right to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, iSimple will issue a credit to your credit card account in the amount of the charge.  Published prices do not include sales tax (if applicable) and insurance. We are required by law to collect sales tax on all shipments to addresses in Florida, Nevada, Missouri and California (at the state/local tax rate).

Product Specifications & Descriptions: Due to the constantly changing and evolving nature of the consumer electronics market, and taking into consideration the technical differences in the equipment of our customers, product descriptions may not reflect current technical information. iSimple cannot be responsible for photographic differences in product size, shape and color.

Not all iSimple solutions work on all automaker's vehicles, and some iSimple products are designed to work only on vehicles equipped with specific factory installed features or hardware. You as an iSimple customer are responsible for reading and understanding all provided technical and applications information prior to purchasing an iSimple product via this Website. If, having read the available technical and applications information, you still have questions regarding the compatibility of an iSimple product with your specific vehicle, contact iSimple Customer Service or Tech Support. iSimple is not responsible for product descriptions or compatibility data listed on 3rd party websites.

Product Availability: All products listed on the Website are available to customers unless otherwise noted. In the event a product is not currently available, a market availability date will be posted if known. iSimple will not allow customers to place pre-orders for products in development unless otherwise specified on the Website.
When an order is placed on the Website, you will receive a confirmation e-mail. However, the receipt of a confirmation only means that we have received your order, and does not constitute a completed sale or an acceptance of the offer to purchase included in your order. A separate e-mail will be sent confirming final purchase of your product and our acceptance of the offer to purchase included in your order. We may change our pricing, product description or specifications after any confirmation e-mail, but prior to shipment, due to errors, changing market conditions, product discontinuation or unavailability or typographical errors. We will notify you of any corrections or changes to your order, and will not complete it until we have your approval.

We reserve the right to limit the quantity of any item sold, or prohibit a sale altogether.

Backorders: Any order that has a product we are unable to ship will be placed in backorder. Backorders will be shipped (unless otherwise advised to cancel pending shipment) when they become available. Some items may require pre-payment.

US/Canada Shipping: iSimple will ship to home addresses within the 50 United States, the District of Columbia, Puerto Rico, the US Virgin Islands, Guam, American Samoa and Canada by United Parcel Service (UPS). If your package is lost or damaged in transit, contact UPS. iSimple will not ship product to a P.O. box address. iSimple reserves the right, at its sole discretion, to cancel any orders submitted for shipment to a freight forwarder or similar entity.

Shipment tracking information for all orders placed via the Website will be sent to the customer by e-mail at the time of shipping. Express Shipping orders will go out by 12:00pm EST on the business day following order processing. UPS charges for Express Shipping include prepaid insurance up to the limits specified by UPS. Standard Shipping orders will go out by UPS within three (3) business days of order processing.

APO/FPO Shipping: iSimple will ship to APO/FPO addresses via the United States Postal Service. Special shipping charges and any special handling charges incurred will be added to the total. All duties and taxes applicable on the purchase are the responsibility of the customer. You will be required to keep proof of your payment of duties and taxes and provide a copy if/when requested. You hereby grant the right to iSimple to charge any unpaid duties and taxes presented to us by the shipper, including a $25 processing fee on your behalf.

Fraud Prevention: In the interest of preventing Internet fraud, iSimple reserve the right refuse shipment of any order to a P.O. Box, or that is submitted with an untraceable email address or invalid telephone number, or for any other lawful reason.

Online Order Payment: You may pay by Visa, MasterCard, Discover or American Express. We do not add any credit card surcharges. Please see our Security and Privacy Statement for more information about credit card safety when shopping online with iSimple. All payments are to be made in USD. Foreign currency equivalent (if applicable) is determined by your creditor or bank, and may include surcharges.

Signature Required: For your protection, UPS carriers require signature upon delivery. iSimple is not responsible for loss of merchandise if a signature waiver is on file or if packages are left unattended on delivery.

Damaged Items: Please inspect your parcel carefully upon receipt. If you receive a damaged item, notify the delivery company immediately (for UPS call 1-800-PICK-UPS). Do not discard any of the box, shipping label, packing material, or broken items. The delivery company will be responsible for picking up the damaged goods and provide you with a claim number. If you so wish, you may provide us the claim number so we can follow up on the claim status. This may take several weeks. We are unable to send our replacement items until the claim is approved, or a payment is made for the 2nd shipment. We will issue a refund to your account promptly upon receiving reimbursement from the shipper.

Legal Notice: All iSimple products and related equipment for sale on the website are sold under the presumption that the purchaser will use it in accordance with applicable federal, state and international (if applicable) laws in a manner that is safe.  The customer will discontinue use of the product as conditions may warrant. iSimple products and associated equipment shall never be installed or used in a manner where it may interfere with safety features or equipment. Do not install an iPod or iPhone cradle or mount in the path of a vehicle's airbag system. iSimple products can be broken when excessive force is applied or if the product is disassembled by an unauthorized party. It has been recorded that on occasion components or wiring connections may become loose from vibration or heat. Small components and packaging materials may present a choking hazard to young children.

Customer Service and Tech Support: iSimple Customer Service and Technical Support is available toll free at 866-788-4237, Monday thru Friday 9:00am to 6:00pm Eastern Standard Time (EST). You may also contact an iSimple representative via the "Contact Us" form on the Website. For product instructions, how-to articles, troubleshooting and FAQ's, please visit the Learning Center on the Website. For product-specific technical information or applications, see the Tech Data and Compatibility tabs for each iSimple product on the Website. iSimple highly recommends professional installation by a qualified automotive electrician or technician on all non-plug-and-play solutions. Tech support via phone assumes a basic level of installer knowledge and is limited to 10 minutes per call.

Dispute Resolution: iSimple endeavors to provide all reasonable methods to resolve any disputes or discrepancies. You, as an iSimple customer, agree to contact us via our toll-free number within 48 hours of any dispute.

Returns & Exchanges: To return an item you must notify us within fifteen (15) days of receipt of your order to obtain a return authorization from iSimple Customer Service. iSimple cannot accept returns that have not been confirmed through Customer Service. The product must be received by us, in original condition and with a full description of why the merchandise was returned, within ten (10) working days of notification of Customer Service. We will refund your merchandise purchase price, less shipping, and a 15% restocking fee. Items returned after fifteen (15) days may be subject to a 25% restocking fee. We will not accept merchandise returned COD or that have not been confirmed first through Customer Service. All parts returned must be in original and (if applicable) resalable condition in the original packaging. All refunds are then subject to inspection of the item. You must use an insured carrier service with a tracking number. Special orders, group buys, or closeout items are not returnable. Refunds should appear typically within 2-3 billing cycles on your credit card statement. Returning a product without first speaking with Customer Service waives our responsibility of having to issue a refund, even if proof of delivery is available, due to our inability to match your purchase with the return; consequently leading to your loss of both the merchandise and any refund.

When visiting a link to a third party site, you leave the iSimple Website. The linked sites are not under our control and we are not responsible for the content of any linked site or any link contained in a linked site.

Governing Law: The Website is operated from within the United States. We make no representation that content on the Website is legal or appropriate for use from outside the United States. This agreement is governed by and construed in accordance with the laws of the State of New York as applied to agreements entered into and performed therein. Any action brought to enforce this agreement or matters related to the Website will be brought in either the state or federal courts of the State of New York, provided, however, that we have the right to institute judicial proceedings against anyone in any other jurisdiction to enforce our rights under this agreement through specific performance, injunction, reformation of contract or similar equitable relief. If any provision of this agreement is unenforceable for any reason, that provision will be severed from this agreement and the remaining provisions of this agreement will remain in full force and effect.

Indemnification: You agree to indemnify and hold harmless iSimple, AAMP of Florida, Inc., their subsidiaries and affiliates and each such person's or entity's respective partners, officers, directors, employees, shareholders, representatives or agents, as well as other End Users, distributors and licensors from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of or related to your violation of this Terms & Conditions, or your violation of any law, regulation or third-party right. 

Intended for Users Over 13 :  The Website is intended for use by individuals 13 years of age or older.

Trademarks and Copyrights: This Website and all materials, images, audio and video clips, information and any other content of whatever nature displayed or transmitted on or over this Website, is the property of iSimple and/or its licensors and parent companies. This content is protected from unauthorized copying and dissemination by copyright law, trademark law, and other intellectual property laws. Any use or modification of the content constitutes an infringement of our copyrights, trademarks and other intellectual propriety rights.
